Wombats Cricket Ground – Terms and Conditions

TERMS AND CONDITIONS FOR THE USE OF CRICKET GROUNDS

  1. Introduction
    1. These Terms and Conditions have been designed to regulate the use of cricket grounds.
    2. By booking cricket grounds you are agreeing to these terms and conditions and you acknowledge that these terms and conditions may vary from time to time.
  2. Bookings and payments
    1. Bookings can either be done online through the WCG booking form on https://www.wombatscc.com/booking/ or through completing a physical booking form.
    2. Bookings will only be confirmed after payment of our invoice. Invoices must be paid in full within [5] days from the invoice date.
    3. Payments must be made by bank transfer to Wombats’ bank account highlighted in invoices. No cash payments can be accepted.
  3. Refunds and cancellations
    1. If you cancel [21] days prior to the date of the booking, you are entitled to a full refund [which will be paid out at the end of the season].
    2. Should you cancel a booking less than [21] days prior to the date of the booking, [a refund will only be given if the ground can be reallocated for the date, time and location, which has been cancelled. You will, however, still be liable to an administration charge of 1000 AED and this will be deducted from the refund due.
    3. A booking no show will not give right to a refund.
    4. Wombats reserves the right to alter or cancel any bookings at any time for any reason or to implement block-out dates. If Wombats would cancel a booking for any reason, you will receive a refund at the end of the season.
    5. If an umpire or referee cancels a game, no refund will be given.
  4. Premises and Grounds
    1. Practice or casual play of any description is prohibited on all cricket grounds unless booked and paid for.
    2. It is your responsibility to ensure teams start and finish matches on time.
    3. No intoxicating liquor or other substances may be brought into the cricket grounds or into the changing rooms.
    4. Dogs or other animals are strictly prohibited from the cricket grounds.
    5. No tent will be permitted without the prior permission in writing of Wombats.
    6. You must clear all litter from the cricket ground and surrounding areas when leaving the ground so it will remain tidy and safe for all other users. Teams who fail to clear their pitch and surrounding area of litter may be charged for additional time and may be banned.
    7. Barbeques and open fires are strictly prohibited. Teams who fail to adhere to this rule will be banned.
    8. If you wish to film on the cricket grounds, you are responsible for obtaining all necessary permissions such as from the individuals involved (parental permission is required for minors) and the relevant UAE Government Departments, to the extent necessary.
  5. Code of conduct
    1. This code of conduct applies to all players, officials, members, participants and spectators.
    2. Wombats has adopted the ICC code of conduct. Please familiarize yourself with the code: https://www.icc-cricket.com/about/cricket/rules-and-regulations/code-of-conduct.
    3. You must not and may be suspended or banned if you do:
      1. Assault or attempt to assault an umpire, another player or spectator;
      2. Abuse either verbally or physically another player, umpire or spectator;
      3. Dispute an umpire’s decision or react in an obviously provocative or disapproving manner towards an umpire, his decision or generally, following an umpiring decision;
      4. Use crude and abusive language, or engage in any form of conduct detrimental to the spirit of the game, or likely to bring the game into disrepute;
      5. Use crude and abusive hand signals or other gestures; and
      6. Refuse to supply your full name and registered address, if any, when required by a person eligible to lodge a report.
    4. The captain of a team may be held responsible for any continuing breaches of this code of conduct by a player in his team, and may be reported for failure to control his team.
    5. Wombats reserves the right to refuse admission at any time to any person or group due to unacceptable behavior or refusing to follow the rules and conditions operating the cricket grounds.
    6. You will not share or post inappropriate content on social media channels such as malicious, discriminatory, harassing or threatening comments, calls to violence, any activity that violates any law or regulation, any potential infringement upon any intellectual property rights of any person, business or place, or content that violates privacy rights or religious sentiments.
  6. Responsibility
    1. You will be responsible for any personal injury, accident or death, or any loss or damage to the facilities or cricket grounds, personal property or vehicles caused by you, any member of your team or any of your spectators or invitees in connection with your booking or registration.
    2. You will keep Wombats harmless and indemnified from and against all actions, claims, demands, costs, losses and expenses, which may be brought or made against it or incurred by it howsoever arising directly or indirectly out of or in connection with your booking or use of the cricket grounds.
    3. You will not make any claim against Wombats in respect of any loss, damage or injury arising as aforesaid.
    4. You will make good, to the satisfaction of Wombats, any damage to the cricket grounds.
    5. You will be held responsible for the behavior of your team whilst on the cricket grounds and in the changing rooms, and any willful damage which ensues.
    6. You are responsible for ensuring that all facilities used by your team after the game are left in a reasonable condition.
    7. Wombats does not accept responsibility for the safe custody of clothing, valuables or any other personal property of any description deposited in the changing rooms or on the ground.
    8. If the pitch is unplayable due to adverse weather conditions, Wombats will attempt to contact you at the earliest possible time on the telephone number provided. However, if you believe that there is a possibility of cancellation due to adverse weather conditions, it is your responsibility to telephone Wombats to check. Wombats will not be held responsible for any inconvenience caused to you or your team members if you do not discover the cancellation until you arrive at the ground.
    9. Appropriate player safety equipment must be worn by all players, both at training and at matches.
    10. You must make your own arrangements for someone to give first aid in the case of injury.
  7. General
    1. You hereby give consent to Wombats to publish your image and or name in any form or medium for general statistical records, general marketing and promotional activities including social media. If you do not consent, a written request should be sent to: [insert name and email address].
    2. Minors under the age of 18 are prohibited to register as a user on the WBC online booking platform and are not allowed to transact or use the website in any other way.
    3. Any dispute or claim arising out of or in connection with these terms and conditions shall be governed and construed in accordance with the laws of the Dubai International Financial Centre.
    4. Any dispute, difference, controversy or claim arising out of or in connection with these terms and conditions, including (but not limited to) any question regarding its existence, validity, interpretation, performance, discharge and applicable remedies, shall be subject to the exclusive jurisdiction of the Courts of the Dubai International Financial Centre, in particular the Small Claims Tribunal.
